“Third Party” means a party other than you and the Teeth at Leumeah.

3.4.2. the number of places booked or for Products, Services, and Third Party Events. In addition, the Teeth at Leumeah shall be entitled to terminate appointments or a Third Party appointment product or service at such time as it shall think fit (or as directed by any relevant Third Party).
3.5. It is your responsibility to check that any Products, Services, provided to you are suitable, accurate and upon receiving such products or services will advise Teeth at Leumeah if the are any problems asap but within the accepted time frames as stipulated by conventions for such products and/or services.
3.6. Any purchase of Products, Services, is only valid when provided by the Teeth at Leumeah or an agent authorised by the Teeth at Leumeah.
3.7. If you wish to change your appointment products, services, to another time, you must contact the Teeth at Leumeah office asap... by telephone. This request may incur financial penalty if sufficient time or reasonable grounds are not provided. Please speak directly to our professional staff for further details.
3.8. If you wish to change your appointment, you must contact the Teeth at Leumeah office asap.
3.9. Except as permitted by clauses 3.7 and 3.8, your Products, Services, may not be transferred or resold for commercial purposes or at a premium as these products are specific to your dental requirements.
3.10. The Teeth at Leumeah (or the relevant Third Party) shall be entitled to make changes as to products, services, surgery times and such other matters as it thinks fit in the case of any professional dental procedure and Third Party products and services.
3.11. By purchasing a product or service, you shall be deemed to consent to your information being used for the purpose of your dental procedure.
3.12. The Teeth at Leumeah (or the relevant Third Party) reserves the right to ask for proof of eligibility for concessions at the our reception and before your dental procedure.
4. ADDITIONAL PROVISIONS APPLYING TO Products, Services, PURCHASED ON THE Teeth at Leumeah WEBSITE
4.1. The website www.teethatleumeah.com is owned and operated by Teeth at Leumeah.
4.2. If you choose to purchase Products, Services, over the Teeth at Leumeah website, your Contract will be concluded as follows:
4.2.1. completion and submission of the relevant Online Form shall constitute an offer by you to purchase Products, Services, subject to these terms and conditions. You can correct any mistakes you make when filling out the relevant Online Form at any point before submitting it;
4.2.2. once you submit the relevant Online Form, the Teeth at Leumeah will check that you have completed all parts of the relevant Online Form and confirm that you have sufficient funds to cover the total cost of your relevant online request. 4.5. You are entirely responsible for entering your details correctly on the relevant Online Form. By submitting a relevant Online Form you warrant to the Teeth at Leumeah that all details supplied by you are true and accurate.
5. PRICE AND PAYMENT
5.1. The price (including all taxes where relevant) of all Products, Services that maybe specified on the Teeth at Leumeah website. from time to time. These details are based on the best available information to the Teeth at Leumeah and the Teeth at Leumeah is not obliged to conclude any Contract on these terms.

5.5. For appointments made over the phone, via email, in person, by post or by fax the Teeth at Leumeah accepts payment by Paypal, American Express, MasterCard, Visa, cheque and /or (save in the case of a Third Party Event, unless the Teeth at Leumeah and the Third Party determine otherwise).
5.6. With regard to the price of Products, and Services (see clause 6 below), the price is non-refundable If you are purchasing Products, and Services, provided by the Teeth at Leumeah.
5.7. If your Products, Services, are being paid for using a third party credit/debit card you must provide the Teeth at Leumeah with written authorization as appropriate from card holder.
6. DELIVERY OF Products, Services.
6.1. Dental Products and Services are provided at the relevant Teeth at Leumeah surgery. Please note that if you purchase Products, and Services for a dental procedure which is scheduled to take place within 7 days of the date of your request for a booking being concluded, your Products, Services are subject to our standard product and service delivery as specified by the Australian Dental Association.
6.2. If you do not choose to proceed with your dental procedure please contact our professional staff asap. If you do not contact Teeth at Leumeah within a sufficient and reasonable time period you agree to pay the standard missed appointment fee.
6.3. The Teeth at Leumeah shall use reasonable endeavors to provide you with a suitable appointment time, Products, and Services at our surgery within a reasonable time of your appointment request.
6.4. Duplicate Products, Services, will not be provided in the case of loss of the originals relating to a Third Party Products and services..
7. REFUND AND EXCHANGE POLICY FOR Products, Services
7.1. Subject to clauses 7.2, 7.3, 7.5 and 8, the Teeth at Leumeah will not refund your Products, Services, after purchase.
7.2. Where the Teeth at Leumeah or the relevant Third Party is unable to perform a procedure on the date(s) agreed because the performance in question is no longer available or viable, and/or is abandoned when less than half the procedure has taken place, the Teeth at Leumeah will not charge you the full cost of the product or service until the relevant /changed procedure has been completed considering the possible circumstances.
7.3. Where a procedure has been temporarily suspended or changed when more than half of the procedure has taken place the Teeth at Leumeah may in its discretion (and provided any relevant Third Party agreements) refund to you the relevant value of the Products, Services that are no longer practicable for your dental requirements or reassign those outstanding funds to the changed procedure..
7.4. The scheduled Products, Services, may be changed with reference to the changed circumstances for later times .(subject to availability and appropriate review of changed circumstances).
7.5. If you do not notify Teeth at Leumeah that the Products and /or, Services are faulty or otherwise not working as expected within a reasonable time the Teeth at Leumeah may, but will not be obliged to, rectify them,
7.6. Teeth at Leumeah will issue a refund to you using the same method of payment that you used to purchase the Products, Services..
8. REFUND CANCELLATION AND EXCHANGE POLICY FOR Products, Services.
Where the Teeth at Leumeah is unable to perform a procedure on the date(s) agreed because the Procedure is no longer available or must be abandoned the Teeth at Leumeah will inform you of this and issue you with a full refund as per relevant particulars of each procedure of the total bill (i.e excluding any delivery charges and ancillary expenditure incurred by you) as soon as possible. For these purposes, a Procedure shall not be treated as abandoned if it is discontinued after one half of such a procedure... has been completed. Teeth at Leumeah will issue a refund to you using the same method of payment that you used to purchase the Products, Services,.
9. ALTERATIONS
All Products, Services, are sold subject to the Teeth at Leumeah right to make any alterations in the Products, Services, details advertised on the Teeth at Leumeah website or other appropriate location.
10. LIABILITIES OF THE Teeth at Leumeah

10.4.2. force majeure which includes war, accidents, acts of public enemies, strikes, embargoes, perils of the air, local disputes and civil commotions;
10.4.3. power failure and failure of other issues as may be specified from time to time.
10.5. 16. ENTIRE AGREEMENT

17. SEVERABILITY
If any part of these terms and conditions is held to be unenforceable this will not affect the enforceability of the remaining provisions.
18. SAFETY AND ENJOYMENT OF SPECIAL APPOINTMENTS
18.1. The Teeth at Leumeah (or the relevant Third Party) reserves the right to refuse appointments and may request any patients to leave (taking any such appropriate action which may be necessary to enforce this right) before or during procedures if it considers it to be necessary or desirable to do so. The Teeth at Leumeah (or the relevant Third Party) may also, on certain occasions, have to conduct security searches to ensure the safety of its staff and other patients.
18.2. Late-appointments will be asked to reschedule or wait until a suitable time for the appointment requested.
18.3. Cans or glass containers may not be brought into the surgery.
18.4. Mobile phones and other electronic equipment must be switched off (not silenced) before entering the surgery.
18.5. As maybe directed by Teeth at Leumeah you must purchase the Products, or Services, before your appointment.
18.6. Unless a procedure is expressly stated to permit entry to children under the age of four, children under the age of four are not permitted to enter the surgery without proper parental control but are welcome in the reception area.
18.7. Please note that special lighting, and other machines are sometimes used in procedures.
18.8. The Teeth at Leumeah and any authorised third parties may carry out general filming and sound recording in or about the surgery. By agreeing to your appointment for Products, Services, you consent to you and your party being included in and to this information gathering activity without payment.
19. THIRD PARTIES
Nothing contained in any Contract is intended to be enforceable pursuant to the Contracts (Rights of Third Parties) Act 1999 by any third party.
20. GOVERNING LAW
These terms and conditions and any Contract concluded incorporating these terms and conditions shall be governed by New South Wales law and all disputes shall be submitted to the exclusive jurisdiction of the New South Wales courts.
The Laws of NSW and the federal Laws of Australia shall govern the operations of this Website. Any and all disputes must be made in writing to the Teeth at Leumeah Address supplied in this website. If the matter cannot be resolved within a reasonable time-frame both parties agree to have the issues heard before an independent registered legal arbitrator in NSW as prescribed by the (Teeth at Leumeah). The parties will agree to the findings and rulings of the independent registered legal arbitrator as prescribed by the (Teeth at Leumeah).
